USCIS Online Change of Address is Available (AR-11)

USCIS Online Change of Address is Available (AR-11)

Furnished by Lal Varghese, Attorney at Law, Dallas

The Change of Address for all non U. S Citizens including Green Card holders is mandatory requirement under section 265 of the Immigration and Nationality Act. The information collected by the USCIS may be sued by U. S Citizenship and Immigration Services for statistical purposes and may be furnished to Federal, State, local and foreign law enforcement officials. Failure to report a change of address is punishable by fine or imprisonment and /or removal from United States if such proceedings are initiated by Immigration and Customs Enforcement agency (ICE).

All people who have an application and/or petition which has been filed with USCIS but has not yet been decided (also known as a 'pending' case) should notify USCIS of any change of address as soon as possible after moving from their present address which is already provided to USCIS so that all future correspondence may be sent to the new address including any decisions made in the pending cases.

The law also requires nearly all non-U.S. Citizens to report a change of address within 10 days of moving by completing a Form AR-11. Abiding by these legal requirements and completing the necessary forms does not update an address on any applications or petitions pending with USCIS. Non-citizens with pending cases must do both.

Most people can now notify USCIS to change their address on a pending case online here on its website at www.uscis.gov. Non-citizens can also now complete the Form AR-11 online on the website.

If you choose to change your address online using the Online Change of Address Notification tool, you will need to have some information available. You need to have the following information available before you can change your address online:

• Your receipt notice or other notice we sent you showing your receipt number (if you have a pending case with USCIS).

• Your new address

• Your old address

• If you have filed a petition for a family member, please have the names and biographical information for that person.

• When you last entered the United States (if you cannot remember this information please fill in an approximate date)

• Where you last entered the United States (through what port of entry you entered - whether by land, sea or air)

If you have the above information you are ready to begin and change your address online at www.uscis.gov

You may be able to update your address with USCIS on the above web site. You must read the terms and conditions, and should accept the same before you can change your address online.

This online change of address tool can allow customers to accomplish two different purposes at the same time:

• For almost all non-U.S. citizens present in the U.S. for more than 29 days, to comply with the legal requirement to notify DHS of any change of address (currently using Form AR-11, Alien's Change of Address Card)

• For individual customers who have pending applications and/or petitions with USCIS to change the address where USCIS should notify them of actions on their case

After filling out the information needed to do an online change of address, you will be asked to select a "Signature" button. By selecting the "Signature" button, you will be certifying under penalty of perjury that the information that you have provided is true and correct.

At the end of the online change of address process, you will be given the opportunity to download or print your completed Form AR-11 for your own records. Even though you are not required to print it out, the USCIS encourages you to print, sign, and date it in permanent ink and keep a paper copy of the electronic submission for your own records.

If you choose to use the online electronic change of address notification, please do not mail in a Form AR-11. On the other hand if you choose not to use this online tool and instead choose to mail in a paper Form AR-11 please understand that doing so will not update your address on any applications or petitions pending with USCIS.

There are many different internet browsers in use today and they do not all behave the same. Therefore, it is strongly suggested that you avoid using your "Back" button during this process and instead rely on the links and buttons provided to you within the pages to complete your Change of Address.

USCIS can only accept a change of address for domestic addresses within the United States. If you have moved to a foreign address, please contact the nearest U.S. Consulate/Embassy.

The system can not store foreign language characters. Please do not place foreign characters in any fields. Certain customers are legally obligated to inform USCIS when they move regardless of whether they have a case pending, approved, or denied. If you are not a U.S. citizen and you have moved, you must complete a Form AR-11 and submit it within ten days of the completion of the move for legal purposes. U.S. Citizens are not required to complete a Form AR-11.

Regardless of whether you are or are not a citizen, if you have previously submitted affidavit of support to sponsor immigrants by filing Form I-864 on behalf of someone who has become a permanent resident, you must also complete a Form I-865 within ten days of the completion of the move for legal purposes.

For case processing purposes, an applicant/petitioner should inform USCIS of any address change as soon after the completion of the move as possible. This way, the applicant/petitioner will receive any notices or documents related to their case in a timely fashion.

Most non-United States (U.S.) citizens who are in the U.S. are required by law to notify DHS of any change of address within 10 days of moving to a new address. Those exempt from this requirement are non immigrants currently in A or G status (e.g. foreign government officials and international organization aliens) and certain non immigrants who do not possess a visa and whose current stay in the U.S. has not exceeded or will not exceed 29 days.
